Terms of Service

The terms and conditions that govern your use of Johnson Studios services, portals, and hosting infrastructure.

1. Agreement to Terms

  • By accessing or using Johnson Studios services, website, or client portals, you agree to be bound by these Terms of Service.
  • If you are using our services on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.
  • If you do not agree to these terms, you may not access or use our services.
  • We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.

2. Services Provided

  • Johnson Studios provides web design and development services, frontend and backend hosting, and ongoing support plans.
  • Services are scoped and priced as described on our pricing page. Custom enterprise engagements are quoted separately.
  • We deliver services remotely. Project timelines are estimates and may vary based on scope, feedback cycles, and complexity.
  • We reserve the right to decline or discontinue service to any client at our discretion.

3. Orders & Payments

  • Orders are placed through our website and confirmed via email or Discord invoice.
  • Pricing is as listed at the time of order. We reserve the right to change pricing for future orders.
  • Monthly hosting and support services are billed on a recurring basis. You may cancel at any time, effective at the end of the current billing period.
  • One-time website build fees are due as outlined in the invoice. Work begins upon payment confirmation.
  • Setup fees, where applicable, are non-refundable once provisioning has started.
  • We accept payments arranged through email or Discord. We do not store credit card information directly.

4. Accounts & Access

  • You must create an account to access client portals and manage your projects, invoices, and support tickets.
  • You may sign in with email/password or through Google, Apple, or Microsoft OAuth.
  • You are responsible for maintaining the security of your account credentials and for all activity under your account.
  • You must provide accurate and current information when creating your account.
  • We may suspend or terminate accounts that violate these terms or engage in abusive behavior.

5. Intellectual Property

  • Website designs, code, and assets created by Johnson Studios for your project are delivered to you upon full payment.
  • Upon full payment, you receive a perpetual, non-exclusive license to use the deliverables for your business.
  • Johnson Studios retains the right to showcase completed work in our portfolio unless you request otherwise in writing.
  • You retain ownership of all content, logos, images, and copy you provide to us for use in your project.
  • Our website, branding, portal software, and proprietary tools remain the property of Johnson Studios.
  • Open-source components used in projects remain under their respective licenses.

6. Hosting Services

  • Hosting services are provided on a monthly subscription basis across frontend and backend tiers.
  • We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows may occur.
  • We perform regular backups but recommend you maintain your own backups of critical data.
  • We reserve the right to suspend hosting services for non-payment, abuse, or violation of these terms.
  • Cancellation of hosting takes effect at the end of the current billing period. Data may be deleted 30 days after cancellation.

7. Support

  • Support is provided based on your active support plan tier (Starter, Professional, Business, or Enterprise).
  • Response times and ticket limits vary by plan as described on our pricing page.
  • Support covers issues related to services provided by Johnson Studios. We do not provide support for third-party services or unrelated technical issues.
  • Support is available via email at support@johnsonstudios.tech and through the client portal ticket system.

8. Limitation of Liability

  • Johnson Studios provides services "as is" without warranties of any kind, express or implied.
  • We are not liable for indirect, incidental, special, or consequential damages arising from your use of our services.
  • Our total liability for any claim related to our services is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for losses caused by factors outside our control, including third-party service outages, internet disruptions, or force majeure events.

9. Prohibited Use

  • You may not use our services for any unlawful purpose or to violate any laws.
  • You may not attempt to gain unauthorized access to our systems, other user accounts, or data.
  • You may not use our hosting to distribute malware, spam, or content that infringes on others' rights.
  • You may not resell or redistribute our services without written authorization.
  • Violation of these restrictions may result in immediate account termination without refund.

10. Refund Policy

  • Website build projects: Refunds may be issued for work not yet started. Once development begins, refunds are prorated based on work completed.
  • Hosting services: No refunds for the current billing period. You may cancel to prevent future charges.
  • Support plans: No refunds for the current billing period. Cancellation takes effect at period end.
  • Setup fees are non-refundable once provisioning or onboarding has begun.
  • Refund requests should be sent to support@johnsonstudios.tech within 14 days of the charge.

11. Governing Law

  • These terms are governed by and construed in accordance with the laws of the United States.
  • Any disputes arising from these terms or your use of our services will be resolved through good-faith negotiation first.
  • If negotiation fails, disputes will be settled through binding arbitration.
  • You agree to waive any right to participate in class action lawsuits against Johnson Studios.
